Official Rules

 

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND

WILL NOT INCREASE YOUR CHANCES OF WINNING.

 

 

1. ELIGIBILITY: THE “Show Us Your Bulova” Sweepstakes (the “Sweepstakes”) is open only to legal residents of the 50 United States, plus D.C., 18 years of age or older, excluding Rhode Island.  Employees of Citizen Watch Company of America, Inc. dba Bulova (“Sponsor”) or any of its parents, subsidiaries and affiliate companies (“Sweepstakes Entities”) as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes participant’s full and unconditional agreement to these Official Rules and decisions of the Sweepstakes judges, which are final and binding in all matters related to the Sweepstakes.  Subject to all applicable laws.  Void in Rhode Island and where prohibited.

 

1. SWEEPSTAKES PERIOD:  The Sweepstakes begins October 15, 2023 at 12:00:01 a.m. Eastern Time (“ET”) and ends November 30, 2023 at 11:59:59 p.m. ET (“Sweepstakes Period”). 
2. HOW TO ENTER:  During the Sweepstakes Period, log in to Instagram or Tik Tok and post a video of yourself capturing the essence of what you like about Bulova (“Post”).  The photo must include (a) you either wearing a Bulova watch, or a piece of paper that legibly says “BULOVA,” and (b) the hashtags #ShowUsYourBulova and #Sweepstakes.   Both hashtags are required.   Only Posts with both hashtags can be counted as entries. Your Instagram or TikTok account must be set to "public" so we can see your photo.  Limit one (1) entry per person and per Instagram and/or TikTok account per person (total of two entries, one per platform).  Each Post must be unique. You must have an Instagram and/or TikTok account to participate.  Accounts are free.    Neither Instagram nor TikTok is a sponsor of or associated in any way with this Sweepstakes.

Entrants are prohibited from using multiple names, Instagram/TikTok accounts, or other means to enter more than once per platform.  Any attempt to do so is grounds for disqualification. Entries of Posts using macro, robotic, script or other forms of automatic entry will be disqualified. Proof of submission does not constitute proof of receipt.  Sponsor’s database computer is the official timekeeping device for the Sweepstakes. If there is a dispute as to the identity of entrant, the prize will be awarded to the authorized account holder of the Instagram or TikTok account associated with the entry, provided that person meets the eligibility requirements. The "authorized account holder" is defined as the natural person to whom the applicable is assigned. No responsibility is assumed for entries and winner notification responses that are lost, delayed, misdirected, misdelivered, illegible, mutilated, incorrect, or incomplete, and any such entries will not be eligible for this Sweepstakes.

1. ENTRY REQUIREMENTS: All videos must: (a) be the exclusive original work of the entrant; (b) be in keeping with the Sponsor’s image; (c) use English as the primary spoken language; (d) comply with all technical and other requirements of the platform on which they are posted; (e) not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon the rights of any person or entity, including but not limited to copyright, trademark, privacy or publicity, (d) not contain any commercial/corporate advertising, including but not limited to corporate logos, brand names, and slogans other than the Sponsor's, (e) not depict any conduct or content that is unsafe, immoral, obscene or otherwise inappropriate as determined by Sponsor in its sole and absolute discretion; and (f) not have been submitted in any other promotion or won any prize. 

 

Each entrant represents and warrants that they have obtained permission from any and all recognizable persons other than the entrant depicted or mentioned in a Post and agrees, upon request, to furnish written proof of such permission.  Failure to meet any of the requirements above, or to otherwise comply with these Official Rules, may result in disqualification.  Sponsor reserves the right to delete or blur any inappropriate content from a Post without disqualifying the entry where, in Sponsor’s determination, such change does not materially alter the Post and the entrant has otherwise attempted in good faith to comply with these Official Rules.

 

1. PUBLICITY/USAGE RIGHTS: By entering, you agree that Sponsor (and those acting with its authorization) may copy, reproduce, edit, broadcast and otherwise use your Post in any way in any medium whether now existing or later discovered, worldwide, in perpetuity, including but not limited to posting it online on Sponsor’s social media pages.   Sponsor reserves the right to remove or reject any content it deems inappropriate for any reason.  Except where prohibited, participation in the Sweepstakes and/or receipt or use of any prize further constitutes each winner’s consent for use of their name, likeness, voice, opinions, statements, biographical information, and/or hometown and state for promotional or advertising purposes in any media, worldwide, now known or hereafter developed, in perpetuity, without further review, notification, payment, or consideration (unless prohibited by law).

 

1. ODDS OF WINNING:  Odds of winning depend on the number of eligible entries received.

 

1. WINNER SELECTION/NOTIFICATION:  Two (2) potential winners will be selected, on or about January 2, 2024 via random drawing from among eligible entries received.  Potential winners will be notified via direct messaging within the platform on which their selected Posts were made. No liability is assumed for any winner notification that is lost, intercepted, returned as undeliverable, or not received by a potential winner for any reason. Failure to respond to any winner notification within five (5) days may result in disqualification and selection of an alternate winner. Failure to comply may result in disqualification and selection of an alternate winner.  In the event that a potential winner is found ineligible, or if he or she has not complied with these Official Rules or declines prize for any reason prior to award, such potential winner will be disqualified, and an alternate winner may be selected.  Each potential winner may be required to sign and return an Affidavit of Eligibility, a Liability Release, and, where legally permissible, a Publicity Release (collectively, "Prize Claim Documents"). Failure to return any Prize Claim Documents when requested may result in forfeiture of the prize and selection of an alternate winner.

 

1. Prizes:  Two (2) prizes are available:  A Bulova Rubaiyat (97P125) with msrp of $675 and a Bulova Jet Star (96B401) with a msrp of $595.[MSOffice1]     Each winner may select a men’s or women’s model of the watch.  Limit one (1) prize per person and per household.   No transferring of prize, prize substitution, or cash equivalent of any prize is permitted, except in Sponsor’s discretion. Sponsor reserves the right to substitute the prize with a prize of equal or greater value in the event an advertised prize becomes unavailable. Allow 8-10 weeks after winner verification for prize delivery.  Each winner is solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with acceptance or use of any prize.

 

1. CONDITIONS OF PARTICIPATION:   By participating in the Sweepstakes, each entrant agrees to release, discharge, indemnify, and hold harmless the Sweepstakes Entities, and those involved in the development, production, implementation, and distribution of this Sweepstakes, including each of their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and each of their respective directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or the Sweepstakes (collectively, "Released Parties"), from any and all liability for any and all claims, damages, losses or injuries of any kind whatsoever, including without limitation, death, and bodily injury, damages, losses or injuries, or any injury, loss or damages of any kind to persons, including death, or property, arising from or relating to, in whole or in part, directly, or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize. 

 

1. GENERAL:  No responsibility is assumed for any printing, typographical, mechanical or other error in these Official Rules, any online or other advertisements for the Sweepstakes, the announcement of any prize, or otherwise in any materials, nor for any electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, communication line failure, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, server, provider, mobile device, electronic, computer, hardware or software malfunctions or limitations of any kind including any injury or damage to entrant’s or any other person’s computer or mobile device related to the Sweepstakes, or inaccurate transmissions of or failure to receive entry information on account of technical problems or traffic congestion on the Internet, at any Web site, on any app, or any combination thereof. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, human error, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes and to select winners from among the eligible entries received that are unaffected by the problem. Sponsor further reserves the right to disqualify any individual who tampers with the entry process, violates these Official Rules, or undermines the integrity of the Sweepstakes.  The Sponsor may prohibit an entrant from participating in the Sweepstakes if it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices or intending to abuse, threaten or harass other entrants. Only the type and quantity of prizes described in these Official Rules will be awarded.  If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s).  Inclusion in such drawing shall be your sole and exclusive remedy in such circumstances.

Caution: Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent of the law.

 

1. DISPUTES: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or in connection with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred with entering into the Sweepstakes; and (3) no punitive, incidental, indirect, special, consequential or other damages, including without limitation lost profits or attorneys’ fees, may be awarded, whether foreseeable or not and whether based on negligence or otherwise (collectively, "Special Damages"), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. For New Jersey residents, the limitations set forth above are inapplicable where attorneys’ fees, court costs, or other damages are mandated by statute.

 

1. Governing Law: This Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of New York, regardless of conflicts of law principles. Any action or litigation concerning this Sweepstakes shall take place exclusively in the federal or state courts sitting in New York County, and each entrant expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Each entrant agrees to service of process by mail or other method acceptable under the laws of the State of New York.

 

1. PRIVACY: By entering the Sweepstakes, each entrant agrees to the Sponsor's use of his/her personal information as described in the Sponsor’s Privacy Policy located at https://www.bulova.com/us/en/terms.html.  

 

1. WINNER LIST: For the winners’ names, send a stamped, self-addressed envelope by December 31, 2023, to Citizen Watch Company of America, Inc. dba Bulova, 350 Fifth Avenue, 29th Floor, New York, NY 10118, Attention Your Bulova Sweepstakes.

1. INSTAGRAM and TikTok:  By participating, you release Instagram, TikTok, and their respective  parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of any prize. The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Instagram or TikTok.
